Regarding the Preservation of Obligations in Connection with the Reorganization

Dear partners,

We hereby inform you that according to the Order of the Ministry of Defence of Ukraine dated May 2, 2025, No. 281 "On the Reorganization of the State Enterprise of the Ministry of Defence of Ukraine ‘State Operator for Non-Lethal Acquisition’," the State Enterprise of the Ministry of Defence of Ukraine “State Operator for Non-Lethal Acquisition” is undergoing reorganization through merger with the State Enterprise of the Ministry of Defence of Ukraine “Defense Procurement Agency,” legal entity identification code 44725823.

This reorganization is being carried out in accordance with the procedures established by law and will not affect the fulfillment of current obligations, including those under state contracts (agreements).

All financial, contractual, and other obligations of the State Enterprise will be transferred to the successor within three months after the cancellation and/or termination of martial law.

Thus, the reorganization is not grounds for suspension, termination, or revision of the terms of existing contracts. The fulfillment of obligations will continue in full, as provided by the norms of Ukrainian civil law, in particular Articles 104–107 of the Civil Code of Ukraine.
